TOPsurreal publishes editorial chart informed by aggregated third-party performance signals, publicly observable data, and industry analytics. All chart rankings are determined at TOPsurreal’s sole editorial discretion.

TOPsurreal reserves the right to modify its chart methodologies, eligibility criteria, and scoring models at any time to reflect evolving industry practices and technological developments. We are under no obligation to disclose proprietary formulas or internal decision-making processes. Chart rankings are editorial opinions and do not constitute legal endorsements or guarantees of commercial success.

4. Chart Purpose, Compensation, Data Reliance

TOPsurreal is not a streaming platform, movies/music distributor, record label, or rights management organization. We do not host, distribute, license, or monetize movies/songs on behalf of creators. TOPsurreal does not pay artists for chart inclusion, nor do we charge fees to be featured. Our charts are informed by trusted third-party industry data providers, and we interpret this data independently to reflect authentic audience engagement. Furthermore, TOPsurreal does not perform exhaustive copyright detection or legal audits. As AI-generated artwork law is rapidly evolving, we align our policies with recognized industry practices and reserve the right to adjust eligibility as legal and ethical norms develop.

5. Eligibility & Copyright Boundaries

All content submitted for consideration or tracked by TOPsurreal must uphold the standards of ethics, transparency, and authenticity, while complying with applicable platform policies and recognized industry standards, including intellectual property and rights of publicity.
Restrictions: Movies and songs that use the recognizable voice, likeness, or identity of a real public figure (living or deceased) without appropriate permission are not eligible for TOPsurreal charts. This includes AI-generated vocal performances that mimic celebrities or influencers where usage is restricted by estates or representatives.

6. Submissions & Creator Participation

TOPsurreal features movies and songs that are entirely or mostly AI-generated, provided they are publicly available on a recognized platform. Creators and fans may submit released AI-generated movie/song for editorial consideration through official TOPsurreal channels.
No Guarantee: Submission does not guarantee chart inclusion or promotion.
Representations: By submitting, you warrant that content does not knowingly infringe on the copyright or rights of publicity of any third party.
Usage: TOPsurreal uses artist name, project name, and associated likeness solely in connection with TOPsurreal’s editorial charts, website, and social media. If the creator wishes to deny the use of this data, they should contact TOPsurreal via official communication channels.

7. Anti-Manipulation & Fair Use

To maintain integrity, users are prohibited from engaging in artificial streaming, repeat-play schemes, or engagement manipulation via bot traffic and fake social activity. Any misrepresentation of metadata or performance metrics is strictly forbidden. Violations of these standards may result in immediate removal from the charts and permanent ineligibility for future consideration.

8. Intellectual Property

TOPsurreal owns all rights, title, and interest in its charts, rankings, logos, and proprietary methodologies. Users may not reproduce or modify TOPsurreal’s intellectual property for commercial use without prior written authorization. Limited personal sharing with proper attribution is permitted.

"As-Is" Disclaimer: TOPsurreal Services are provided on an “as is” basis. To the fullest extent permitted by law, TOPsurreal and its affiliates shall not be liable for any damages arising out of your use of the Services, including chart placement changes, removal from charts, or reliance on editorial decisions.

11. Modifications to Terms

TOPsurreal reserves the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Services constitutes acceptance of the updated Terms.

Any disputes shall first be addressed through good-faith discussion, followed by mediation, and, if unresolved, binding arbitration.

13. DMCA Notice & Takedown Policy

TOPsurreal respects intellectual property rights and complies with the DMCA. TOPsurreal does not host, store, or distribute any video or audio files on its servers. All media content is embedded from third-party platforms (e.g., YouTube) in accordance with their terms of service.
While TOPsurreal does not host artworks, we may take editorial action (such as removing a chart listing) if we receive a valid notice regarding content referenced on our charts.
